Pocket coaching availability between our calls via Voxer. Sometimes you just wish you had "Beth Ann in your pocket."  Access my 30 years' experience + donor scripts outside our coaching calls.

My expert eyes on your donor communications - when you need another set of eyes, or some insights into donor behavior, I'll review your donor-facing documents - emails, proposals, and other correspondence - to ensure you're working at your most effective

BETH ANN LOCKE PROGRAM AGREEMENT

Welcome!
I’m thrilled to support you in your major gift journey inside this program. By choosing to embark in this container, you’ll be joining other purpose-driven fundraisers and nonprofit leaders. Let’s get started!

Why you’re Reading This:
I prefer to communicate honestly and openly. This Program Agreement (the “Agreement”) outlines what we can expect from each other in working together. If there is anything you are uncomfortable with, or if the program is not meeting your expectations, please let me know immediately. I can only consider adjustments if things are communicated with me.

In exchange for agreeing to work with me, Beth Ann Locke, you agree to be bound by the following conditions.

  1.  This Agreement is made between The Fundraiser Coach, a company in British Columbia, Canada (aka “Beth Ann Locke”, “Beth Ann” “I”, and “me”) and you, the person who has clicked ‘I Agree’ to this Agreement (aka “you” and “your”).
  2. My Promise to You.I will provide you with a group program. will provide you with a group program as outlined on the sales page or check out page. As your coach and mentor, I commit to not holding back, and to showing up fully in support of you.
  3. Term + Termination.This Agreement will be binding upon your electronic acceptance of this Agreement and will last for as long as the time determined by the scope of work outlined in Schedule “A” Services + Cost.
  4.  Please note that if you violate any of the expectations outlined in Schedule “B” Rules + Guidelines, Beth Ann may terminate this Agreement effective immediately and you will not be entitled to any refunds or any continued working relationship with Beth Ann Locke.
  5. What Beth Ann Locke Expects of You.Just as you are investing in me, I’m also investing my time, energy and expertise in you. To achieve maximum results, I asks that you commit to the following:
    1. You commit to showing up fully, taking personal responsibility, leaning into new learnings, and use everything for your growth and fundraising mastery.
    2. You understand the power of the coaching and training relationship can only be granted by you, and if something’s not working, you commit to communicating.
    3. You commit to being supportive and uplifting to other people in the program.
    4. You commit to being anti-racist, antisemitic, anti-bullying, and anti-harassment.
  6. Cancellations and Refunds. Jumping into a group program is a commitment, so be sure that you are 100% committed to the process. With that in mind, this is how I’ve drafted my refund policy:
    1. All group programs packages are final sale. There are no refunds.
    2. In The Q4 Closer programs, refunds are possible under the following conditions: If you follow all the training, steps, and coaching I provide, including making at least 10 Asks to major gift supporters, and you still aren’t able to close at least $10,000 in donations before December 31st, I will happily refund you in full.
    3. Beth Ann reserves the right to cancel your access to the program if you are not meeting the Respectful Working Expectations we’ve set out in Schedule “B” Rules + Guidelines.
    4. If you choose to leave the program before your contract is complete, you will still be responsible to pay any remaining money owed.
  7.  I will be providing you with a group program, as outlined in Schedule “A” Services + Cost, and per the program sales page or checkout page.
  8.  You will have access to scheduled calls as noted in Schedule “A” Services + Cost, and per the program sales page or check out page.
  9. No Guarantees.While there are some things I can control, like how much I will support you, there are some things I cannot control. As such, no guarantees can be made for the results from the program.
  10.  Please acknowledge you are fully responsible for everything you give and get from this process and program. I’ve created the group program and used my experience and qualifications to bring you the greatest benefits possible, but none of that can happen if you do not put in the work.
  11.  Payment details and cost for your group program are outlined in Schedule “A” Services + Cost.
  12.  All communication will be done via email, Zoom, or Voxer.
  13.  I expect you to speak up if anything isn’t sitting right with you and bring it to my attention in a timely manner.
  14.  All prices are in US Dollars and all payments must be made in US Dollars. Payment will be made in accordance with the payment method outlined in Schedule “A”.
  15.  We operate and grow in a safe space. I want you to know that everything shared in our community is strictly confidential, unless you give permission to share.
  16. Ownership of Materials.All the content that I provide to you, such as training videos and PDFs, are for your use only and are not to be re-distributed or re-used.
  17. Standard Legal Things.
    Jurisdiction. This Agreement will be governed exclusively by the laws of the Province of British Columbia.
    Severability. If any provisions of this Agreement are invalid or unenforceable, the other provisions in the Agreement will remain in full force and effect.
    Entire Agreement. This Agreement constitutes the entire Agreement between the parties and replaces any prior agreements. 
    Waiver of Breach. The waiver by me of any breach by you of any provision of this Agreement will not be taken to be a waiver of any further breaches by you. 
      For the purpose of this Agreement, e-mail or text will suffice for written notice when required as set out above. 
    Headings. The headings used in this Agreement are for stylistic purposes only and none of the content in the headings are intended to be legally binding. 
    Counterparts. This agreement may be signed in any number of counterparts, each of which is an original, and all of which taken together constitute one single document. 
    Online Agreement. We agree that this Agreement may be signed electronically or agreed to by having you click “I Agree”, the effect of which will be the same as if we signed the Agreement by hand and the intention of which is that both parties desire to be bound by all the terms of the Agreement.

SCHEDULE “A    

Fees: In consideration of your access to the Program, you agree to pay the fees connected to the sales page and checkout form. We offer pay in full option or monthly payments. Taxes are included for Canadian residents, and international members are not subject to tax as per CRA rules. If you opt for monthly payments, you shall be automatically charged every month thereafter, for the term of your program. 

Payment Plan Authorization: You hereby authorize the Company to charge your credit card or debit card automatically according to the terms set forth in the Fees section above.

Refund Policy: As per section 5 above.

Payment Method: Made by credit card or bank card through Stripe, via the program check-out page.

SCHEDULE “B” RULES + GUIDELINES

The following are the Respectful Working Expectations for the Group that Beth Ann Locke holds for all clients in the group. If you are breach in any of these, I reserve the right to terminate this Agreement immediately.

  1. Be positive, supportive and encouraging of yourself and others.
  2. Use the group as part of your process towards gaining insight into your growth and expanding skill set.
  3. Remember that we are not here to fix other people, rather to uplift and support each other. Ask someone for permission before offering advice and be clear in what feedback you are seeking from others.


With that in mind, here are some examples of what the group permits and encourages:

  • Sharing of insights, wins, and ‘Aha’ or clarity moments
  • Outlining your goals and how you plan to achieve them
  • Fundraising and philanthropic relationship breakthroughs
  • Questions related to the program content that the group can help with


Guidelines for behaviour that is not allowed and will result in a breach of your Agreement:

  • No selling or sales pitches promoting your own programs inside of the group. Nothing self-promotional or invitations asking other members to join groups or programs. I
  • No judging other people and making negative comments to other members of the group
  • No negative comments, rants, or complaint, and no off-topic questions that distract the group from focusing on the content
  • No racist, antisemitic, bullying or harassing comments to other members of the group
